Terms and conditions of sale

1. Introduction

These general terms and conditions (hereinafter the "Conditions") apply to all agreements, orders, and deliveries of products by DUAE (hereinafter "we", "our", "us") to customers (hereinafter "customer", "you", "your"). DUAE is a company incorporated under Belgian law, with its registered office at Muizensteenweg 89, 2820 Bonheiden, registered in the trade register under number 1011.063.761, VAT number: BE1011.063.761.

 

2. Applicability

 

2.1 These Conditions apply to all orders and agreements placed via the DUAE website, by phone, or otherwise, unless otherwise agreed in writing.

 

2.2 By placing an order, the customer acknowledges having read, understood, and accepted these Conditions.

 

3. Offer and Contract Formation

 

3.1 All offers from DUAE are non-binding, unless otherwise stated in writing.

 

3.2 An agreement is concluded when DUAE confirms the customer's order, either by written confirmation or by delivering the products.

 

3.3 DUAE reserves the right to refuse orders, for example, in case of doubt about the customer's age or in case of incorrect information provided by the customer.

 

4. Prices and Payment

 

4.1 All listed prices are inclusive of VAT, unless otherwise stated.

 

4.2 Payment must be made via the payment methods offered on our website, such as bank transfer or other approved payment systems.

 

4.3 Payment must be made in full within 14 days after the invoice date, unless otherwise agreed. This corresponds to the due date of the invoice.

 

4.4 In case of non-payment within the stipulated period, DUAE reserves the right to charge a financial fee for the delay. This fee amounts to 10% of the outstanding amount per month.

 

4.5 In case of non-payment after the due date, DUAE further reserves the right to suspend the delivery of the products or cancel the agreement, without affecting the further liability of the customer.

5. Delivery and Transfer of Ownership

 

5.1 DUAE aims to ship orders within 7 working days after receipt of the order, unless otherwise agreed.

 

5.2 Delivery will take place at the address provided by the customer. All deliveries are carried out by DUAE itself.

 

5.3 The risk of loss or damage to the products passes to the customer at the time of delivery.

 

5.4 DUAE is not liable for delays in delivery that are beyond its control (force majeure).

 

6. Returns and Right of Withdrawal

 

6.1 In accordance with Belgian law, the customer has the right of withdrawal for 14 days after receiving the products.

 

6.2 The right of withdrawal does not apply to products that cannot be returned for hygienic reasons, such as opened bottles of alcohol.

 

6.3 If the customer exercises their right of withdrawal, they must return the products in an undamaged and unopened condition within 14 days. The customer bears the costs for the return shipping.

 

6.4 Refunds will be made within 14 days after receipt of the returned products, minus the shipping costs.

 

7. Liability

 

7.1 DUAE is not liable for any damage resulting from incorrect use of the products, such as failure to follow the recommended usage instructions or alcohol consumption by minors.

 

7.2 DUAE is only liable for damage that is the direct result of a failure to perform the agreement, provided that such damage is the result of intentional or gross negligence by DUAE.

 

7.3 DUAE shall not be liable for indirect damages, such as loss of profits or consequential damage.

 

7.4  Subcontractor's quasi-immunity. DUAE is not liable for damages when it acts as a subcontractor

8. Intellectual Property Rights

 

8.1 All trademarks, logos, labels, and other intellectual property rights relating to DUAE’s products are the property of DUAE or its licensors.

 

8.2 The customer may not use these trademarks, logos, or other properties without prior written consent from DUAE.

 

9. Privacy and Data Protection

 

9.1 DUAE processes the personal data of the customer in accordance with the applicable data protection laws (GDPR).

 

9.2 The customer has the right to access, correct, or delete their data via DUAE's customer service, requested through duaevodka@gmail.com or via the contact form.

 

10. Complaints and Disputes

 

10.1 If the customer has a complaint regarding the products or delivery, they can contact DUAE's customer service via duaevodka@gmail.com or through the contact form.

 

10.2 Disputes between DUAE and the customer will initially be resolved through mutual agreement. If no solution is found, Belgian courts will have jurisdiction.

 

11. Force Majeure

 

11.1 DUAE is not liable for any delay or failure to fulfill its obligations if caused by force majeure, such as natural disasters, war, strikes, shortages in production or delivery, or other circumstances beyond DUAE’s control.

 

11.2 In case of force majeure, DUAE will inform the customer as soon as possible about the delay or change in delivery.
